# MiniApp Platform Original Content Protection Guide

This guide aims to help developers or companies (hereinafter referred to as "complainants") prepare and submit effective complaint materials according to platform requirements when they discover that third-party Tuya-enabled MiniApps infringe upon their legitimate rights and interests (such as copyright, trademark rights, patent rights, reputation rights, privacy rights, etc.), so as to protect their rights and interests.

Please note that the Tuya platform, as a neutral AI cloud platform service provider, bases its processing on compliant materials submitted by complainants and relevant laws and regulations. Ensuring that materials are authentic, complete, and legal is the key to successful complaints.

## I. Pre-complaint Preparation: Collecting and Organizing Evidence

Before formally submitting a complaint, please be sure to systematically prepare the following materials. Incomplete materials are the most common reason for complaint failure.

### 1. Rights Ownership Certification Documents

- **Copyright infringement (such as code, UI design, images, text, video, audio plagiarism):**
  - Official copyright registration certificate.
  - Proof materials of the first publication or completion of the work (such as timestamps, source files, development logs).
  - If it is a design or artwork, provide the design draft source files.
- **Trademark infringement (such as unauthorized use of your brand name, Logo):**
  - Trademark registration certificate or trademark acceptance notice.
  - Trademark authorization certificate (if you are an authorized party).
- **Patent infringement:**
  - Patent certificate, patent specification, patent annual fee payment certificate.
- **Other rights:** Provide corresponding ownership certificates according to specific infringement types.

### 2. Infringement Evidence

- **Clear infringement comparison description:**
  - Clearly point out which specific content (pages, functions, text, images, etc.) in the complained mini app infringes your rights.
  - It is recommended to use tables or bullet points to list your rights content and infringing content one by one.
- **Infringement content evidence:**
  - **Screenshots and screen recordings:** Take full-process screenshots or screen recordings of the infringing mini app's interface, functions, and content, ensuring that the mini app name, mini app ID, and infringing content can be clearly seen. Screen recording is the best method as it can dynamically demonstrate the infringement process.
  - **Notarization:** For major or complex infringement cases, it is strongly recommended to go to a notary office for evidence preservation notarization to enhance the legal validity of the evidence.

### 3. Complainant Information

- **Natural persons:** Valid identity documents.
- **Legal persons and other organizations:** Copies of business licenses or organization licenses (with official seal).
- **Agents (if any):** Authorization letter from the complaint handler (with official seal) and valid identity documents of the handler.

### 4. Complaint Letter/Rights Declaration (template attached)

- Accurate information of the complained mini app (mini app name, mini app ID, or device ID corresponding to the mini app).
- Clear complaint demands (for example: requiring immediate removal of infringing mini apps, deletion of infringing content, etc.).
- Preliminary reasons for infringement and evidence list.
- Complainant guarantee: Declare that the complaint content is true and legal, and promise to bear all legal responsibilities arising from false complaints.
- Complainant signature/seal.

## II. Formal Complaint Process

- Submit complaints via email to abuse@tuya.com according to the complaint letter/rights declaration template.
- After submission, wait for review. The platform will conduct review within the specified working days (usually 7-15 working days) and follow up through email.

## III. Notes

- **Accurate information:** Ensure that the complainant information, ownership certification information, and complained mini app ID are accurate. Any error may result in the complaint being rejected.
- **Sufficient and strong evidence:** The evidence chain should be complete and clear. Simple text descriptions lack persuasiveness. "Pictures and text with video evidence" is the most effective method.
- **Timeliness:** After discovering infringement, the complaint procedure should be initiated as soon as possible to prevent damage from expanding.
- **Maintain communication:** After submitting a complaint, pay close attention to platform notifications and respond promptly if additional materials are needed.
- **Legal channels:** If you are not satisfied with the platform's handling results, or if the infringement is particularly serious, you should consult a lawyer and prepare to resolve the issue through administrative complaints or judicial litigation.
- **Honest complaints:** Do not make malicious complaints or submit false materials, otherwise you may be penalized by the platform or even bear legal responsibility.

IV. Infringement Facts and Reasons

After investigation, the mini app has used [specific infringing content such as images, text, functional logic, etc.] that is substantially similar to our [specific rights content] in its [specific page locations such as "homepage", "product page"] without our permission, which constitutes serious infringement (see Attachment [Attachment 2: Infringement Comparison Evidence]). This behavior violates relevant provisions of the Copyright Law of the People's Republic of China, the Trademark Law of the People's Republic of China, and other laws, and also violates the Tuya Developer Platform rules.

V. Complaint Demands

We hereby solemnly request your platform to:
- Immediately take necessary measures such as rectification or removal of the infringing mini app;
- Inform the complainant of the handling results.

I/Our company promise: The content of this complaint letter is true and legal, and we voluntarily bear all legal responsibilities arising from false complaints.
